How Ofuel collects, uses, shares, stores and protects personal information.

Ofuel is committed to protecting your privacy and processing personal information lawfully, fairly and transparently. This Privacy Policy explains how we handle personal information when you visit ofuel.co, buy our products, create an account, join a subscription or loyalty programme, communicate with us, participate in promotions, submit reviews or interact with our digital channels.

For purposes of the Protection of Personal Information Act 4 of 2013 (“POPIA”), the responsible party is Senture Data Solutions (Pty) Ltd, registration number 2021/845330/07, trading as Ofuel (“Ofuel”, “we”, “us” or “our”).

1. Scope

This Policy applies to personal information processed through our website, online store, customer support channels, social media pages, subscription services, promotions, surveys, wholesale enquiries and related services. It does not govern third-party websites or services that operate under their own privacy policies.

2. Personal information we collect

We collect only the information reasonably necessary for the purposes described in this Policy. Depending on how you interact with us, this may include:

  • Identity and contact information, such as your name, surname, email address, mobile number and delivery or billing address.
  • Account information, such as login details, saved preferences, subscription status and account history.
  • Order and transaction information, such as products ordered, order value, discount usage, fulfilment status, returns and refund history.
  • Payment-related information. Payments are processed by authorised payment providers. We generally receive payment status, transaction references and limited card information, rather than your full card details.
  • Customer support information, including emails, messages, call notes, WhatsApp interactions, complaints and other correspondence.
  • Marketing and preference information, including consent records, communication preferences, campaign engagement and interests inferred from interactions with our content.
  • Loyalty, referral, review and user-generated content, where these services are offered.
  • Technical and usage information, such as IP address, browser, operating system, device identifiers, pages viewed, clicks, referring pages, approximate location and session data.
  • Wholesale or business enquiry information, including company, role, business contact details and purchasing requirements.
  • Any other information you voluntarily provide to us.

Data minimisation
Ofuel does not intend to collect identity or passport numbers, detailed health records or other special personal information through ordinary purchases. Ofuel does not currently intend to collect health, pregnancy or medical information through any quiz, consultation or personalised product-selection process. Accordingly, no special personal information, as contemplated in sections 26 to 33 of POPIA, will be collected through these processes at launch. Should Ofuel introduce a health-related questionnaire, consultation or personalised recommendation process in future, the relevant privacy notices, consent mechanisms, security safeguards and internal processing procedures will be implemented before such information is collected.

3. How we collect information

  • Directly from you when you place an order, create an account, subscribe, complete a form, contact us, enter a promotion or submit content.
  • Automatically through cookies, pixels, analytics tools, log files and similar technologies when you use our website or digital channels.
  • From service providers involved in payments, fulfilment, fraud prevention, subscriptions, marketing, customer support, loyalty and analytics.
  • From social media platforms or other third parties when you interact with our pages, use a social sign-in feature or consent to the sharing.

4. Why we process personal information

  • To process payments, fulfil orders, arrange delivery and provide order updates.
  • To create and manage customer accounts, subscriptions, loyalty benefits and preferences.
  • To provide customer support, process returns, refunds and complaints, and maintain service records.
  • To verify transactions, detect fraud, protect our systems and enforce our terms.
  • To communicate operational information, including order, delivery, product safety and subscription notices.
  • To send marketing by email, SMS, WhatsApp, push notification or other electronic means where permitted by law and your preferences.
  • To analyse website use, campaign performance and customer behaviour, improve our products and services, and personalise relevant experiences.
  • To administer promotions, surveys, referrals, reviews and community activities.
  • To meet legal, tax, accounting, regulatory and record-keeping obligations.
  • To establish, exercise or defend legal rights.

We process personal information based on consent, performance of a contract, compliance with legal obligations and/or our legitimate interests, where permitted by POPIA. You may withdraw consent where consent is the basis for processing, but withdrawal will not affect processing already carried out lawfully.

5. Cookies and similar technologies

Our website may use essential, functional, analytics and advertising cookies or similar technologies. Essential cookies are required for core functions such as checkout, security and account access. Other cookies help us understand site usage, remember preferences and measure or personalise marketing.

Where required, you can manage non-essential cookies through our cookie banner or browser settings. Blocking cookies may affect parts of the website. A POPIA-compliant cookie consent banner will be active on the Ofuel website at launch.

The banner will distinguish between strictly necessary cookies and non-essential cookies, such as analytics, advertising and tracking cookies. Non-essential cookies will not be activated unless the user has made an informed choice and provided consent.

Users will be able to accept, reject or manage non-essential cookies and may change or withdraw their consent at any time through the website’s cookie settings. Further information about the cookies used, their purposes and retention periods will be provided in Ofuel’s Cookie Policy.

6. Direct marketing

We may send direct marketing where you have consented or where applicable law permits communication with an existing customer about similar products or services. Every electronic marketing message will provide a reasonable way to opt out. You can unsubscribe at any time without charge, although we may still send essential service messages relating to orders, subscriptions, safety notices or account administration.

We will not sell your personal information to third parties for their independent direct marketing.

7. When we share personal information

We may share personal information with carefully selected operators and service providers that help us run Ofuel, including:

  • e-commerce hosting and website providers;
  • payment gateways, banks and fraud-prevention providers;
  • warehouse, fulfilment, courier and delivery partners;
  • subscription, loyalty, review, customer-support and communication platforms;
  • email, SMS, WhatsApp, advertising and marketing technology providers;
  • analytics, hosting, cloud storage, cybersecurity and technical support providers;
  • professional advisers, auditors, insurers and regulators;
  • law-enforcement bodies or other persons where disclosure is required or permitted by law;
  • a buyer, investor or successor in connection with a legitimate corporate transaction, subject to appropriate confidentiality and privacy safeguards.

Operators may process information only for authorised purposes and are required to protect it appropriately. Ofuel’s e-commerce platform is hosted on Shopify. Stitch is used as the payment gateway, and Bob Go (formerly uAfrica) is used for courier integration, shipping and order fulfilment.

8. Cross-border transfers

Some service providers may store or process personal information outside South Africa. Where we transfer information internationally, we will take reasonably appropriate steps to ensure that the recipient is subject to an adequate law, binding rules or agreement, that you have consented, or that another lawful basis under POPIA applies.

9. Information security

We use appropriate and reasonable technical and organisational safeguards designed to protect personal information against loss, damage, unauthorised destruction, unlawful access or processing. These measures may include access controls, encryption in transit, secure payment processing, system monitoring, backups and contractual safeguards with operators. No system is completely secure, and we cannot guarantee absolute security.

10. Security compromises

Where there are reasonable grounds to believe that personal information has been accessed or acquired by an unauthorised person, we will investigate and notify the Information Regulator and affected data subjects as soon as reasonably possible, subject to POPIA and lawful directions.

11. Retention

We retain personal information only for as long as reasonably necessary for the purpose for which it was collected, to comply with legal or contractual obligations, resolve disputes, prevent fraud and enforce agreements. When information is no longer required, we will delete, destroy or de-identify it in a reasonably secure manner. Transaction, tax and accounting records may be retained for the periods required by law.

12. Your rights

Subject to POPIA and other applicable law, you may:

  • ask whether we hold personal information about you;
  • request access to your personal information, subject to lawful grounds for refusal and any prescribed fee;
  • request correction, updating, deletion or destruction of inaccurate, irrelevant, excessive, outdated, incomplete, misleading or unlawfully obtained information;
  • object to processing on reasonable grounds where applicable;
  • withdraw consent and opt out of direct marketing;
  • complain to us or the Information Regulator about unlawful processing.

13. Children

Our website and products are intended for persons aged 18 years or older. Persons under the age of 18 should not purchase or use our products unless specifically advised to do so by a qualified healthcare professional and with the consent of a parent or legal guardian.

Our products are not intended to diagnose, treat, cure or prevent any disease. Customers who are pregnant, breastfeeding, taking medication or managing a medical condition should consult a qualified healthcare professional before using any nutritional supplement.

We do not knowingly collect personal information from children without the consent of a competent person or another lawful basis. If you believe a child has provided information unlawfully, please contact us.

14. Third-party links and social platforms

Our website or social pages may link to third-party services. We do not control their privacy practices and encourage you to review their policies before providing information. Your use of social media is also subject to the relevant platform’s terms and privacy settings.

15. Changes to this Policy

We may update this Policy to reflect changes in law, technology or our services. The updated version will be posted on the website with a revised effective date. Material changes may also be communicated through appropriate channels.
